Terms of Use

By downloading, installing, accessing, or using Planex (the "Application", "Service", or "Planex AI"), you agree to enter into a legally binding agreement under these Terms of Use ("Terms") and our Privacy Policy.

If you do not agree to these Terms in full, you must not install or use the Application and must immediately delete it from your device.

Auraluxe grants you a revocable, non-exclusive, non-transferable, and limited personal license to install and use Planex on Android-compatible devices solely for your personal productivity, planning, and AI conversational assistance.

Eligibility: You represent and warrant that you are at least 13 years of age (or at least 16 years of age if located in the European Economic Area). If you are under the age of majority in your jurisdiction, you may only use Planex with the consent of a parent or legal guardian.

Planex utilizes advanced probabilistic machine learning models (including Google Cloud Vertex AI and DeepSeek) and autonomous web retrieval heuristics to generate answers, schedules, summaries, code, and images.

Your Input Content: You retain all intellectual property rights in the text prompts, documents, images, and audio you submit to Planex. You grant Planex a limited, royalty-free, worldwide license strictly to process, translate, format, and transmit your input solely to generate your requested outputs and maintain your account synchronization.

AI-Generated Output: To the maximum extent permitted under applicable law, Auraluxe assigns to you all of its right, title, and interest (if any) in the text, code snippets, and visual images generated specifically for you in response to your prompts.

Planex Property: The Application code, design architecture, UI/UX layouts, animations, trademarks, logos, and proprietary system prompts remain the exclusive intellectual property of Auraluxe.

You agree to adhere strictly to our safety guidelines and Google Play AI-Generated Content Policies. You shall not use Planex to:

• Generate, transmit, or solicit Child Sexual Abuse Material (CSAM), non-consensual sexual imagery, or graphic violence.
• Promote suicide, self-harm, terrorism, hate speech, discrimination, or illegal schemes.
• Generate malware, computer viruses, ransomware, phishing lures, or automated cyberattack scripts.
• Attempt prompt injection, jailbreaking, or evasion of safety filters designed to protect platform security.
• Reverse-engineer, decompile, disassemble, or extract proprietary model endpoints or API keys from the APK.
• Deploy automated scrapers, bots, or DoS tools to overload backend inference capacity.

Violations will result in immediate and permanent account termination without prior notice or refund.

Planex provides free standard usage alongside optional premium subscription tiers (Planex Plus, Planex Pro, and Planex Max) which unlock higher token quotas, priority throughput, and advanced models:

• Google Play In-App Billing: All financial transactions, subscriptions, and recurring payments are handled exclusively by Google Play In-App Billing under Google Play Terms of Service.
• Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless you cancel at least 24 hours prior to renewal.
• How to Cancel: You can cancel your subscription at any time via Google Play Store App $\rightarrow$ Profile $\rightarrow$ Payments & Subscriptions $\rightarrow$ Subscriptions $\rightarrow$ Planex. Your premium benefits remain active until the end of the paid period.
• Refunds: Refund requests are governed by and must be submitted directly through the Google Play Store refund process.

To ensure 99.9% uptime, equal access, and protect backend GPU compute against denial-of-service abuse, Planex employs dynamic rate-limiting:

• 5-Hour Sliding Window Quotas: Token and compute allowance is calculated across a continuous 5-hour rolling window.
• Monthly Cycle Caps: Tier-specific monthly token allocations reset on your 30-day billing cycle.
• Sliding Reset: When a rate limit is reached, you can monitor the live countdown in the in-app Usage Limits screen. Service unlocks automatically when your rolling window advances.

You have the absolute right to terminate your account at any time. In full alignment with Google Play Account Deletion requirements, you may delete your account and all associated cloud data via:

• In-App: Open Settings $\rightarrow$ Account Management $\rightarrow$ Delete Account.
• Web Portal: Submit an account deletion request via our Account Deletion Request Portal.

Upon deletion, your authentication record, conversation history in Cloud Firestore, and token buckets are permanently and irreversibly purged.

PLANEX IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AURALUXE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR COMPLETELY FREE OF ERRORS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AURALUXE, ITS DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) PLANEX, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
